These Terms of Service reflect the way NDmed.net's business works, the laws that apply to our company, and certain things we’ve always believed to be true. As a result, these Terms of Service help define NDmed.net's relationship with you as you interact with our services. These terms include the following topic headings:

To better our services, we're continually creating new technologies and features. For instance, we employ artificial intelligence and machine learning to better detect and filter spam and malware, as well as to offer you simultaneous translations. As part of this continuous improvement, we occasionally add or remove features and functions, raise or lower service restrictions, and launch new services while discontinuing others. When a downloadable piece of software is needed or provided as part of a service, it may occasionally update itself automatically on your device if a new version or feature becomes available. You can change the settings for automatic updates on some services. We'll provide you fair early notice if we make significant changes that have a negative impact on how you use our services or if we discontinue providing a service.
You're responsible for your conduct when using our services. You agree not to use our services in any way that violates any applicable local, state, national, or international law or regulation. You also agree not to use our services in any way that is unlawful or harms us or any other person or entity. For example, you agree not to:
We continue to give you permission to use our services as long as you comply with these terms and any other service specific terms of service agreements.
You also agree that our Privacy Policy applies to your use of our services.
Although we give you permission to use our services, we retain any intellectual property rights we have in the services.
If you find that others aren’t following these rules, many of our services allow you to report abuse.
Some of our services are designed to let you upload, submit, store, send, receive, or share your content. You have no obligation to provide any content to our services and you’re free to choose the content that you want to provide. If you choose to upload or share content, please make sure you have the necessary rights to do so and that the content is lawful.
Your content remains yours, which means that you retain any intellectual property rights that you have in your content. For example, you have intellectual property rights in the creative content you make, such as reviews you write. Or you may have the right to share someone else’s creative content if they’ve given you their permission.
We need your permission if your intellectual property rights restrict our use of your content. You provide NDmed.net with that permission through this license.
This license covers your content if that content is protected by intellectual property rights.
This license does not cover your content if that content is not protected by intellectual property rights.
This license doesn’t affect your privacy rights — it’s only about your intellectual property rights

You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use your content as necessary to provide the services to you. This license ends when you delete your content or your account unless your content has been shared with others, and they have not deleted it.

If you remove from our services any content that’s covered by this license, then our systems will stop making that content publicly available in a reasonable amount of time. There are two exceptions:
If you already shared your content with others before removing it. For example, if you shared a post with a friend who then made a copy of it, or shared it again, then that post may continue to appear in your friend’s NDmed.net Account even after you remove it from your NDmed.net Account.
If you make your content available through other companies’ services, it’s possible that search engines, including Online Search, will continue to find and display your content as part of their search results.
When you use our services, you must follow the law and these terms. This includes our policies, such as our Privacy Policy and Community Guidelines.
You need a NDmed.net Account to use some of our services. You may create your own NDmed.net Account, or your NDmed.net Account may be assigned to you by an administrator, such as your employer or educational institution. If you are using a NDmed.net Account assigned to you by an administrator, different or additional terms may apply and your administrator may be able to access or disable your account.
If you meet these age requirements you can create a NDmed.net Account for your convenience. Some services require that you have a NDmed.net Account in order to work — for example, to use NDmed Mail, you need an NDmed.net Account so that you have a place to send and receive your email.
When you create a NDmed.net Account, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the terms, which may result in immediate termination of your NDmed.net Account.
You are responsible for safeguarding the password that you use to access the services and for any activities or actions under your password, whether your password is with our services or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your NDmed.net Account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
Many organizations, such as businesses, non-profits, and schools, take advantage of our services. To use our services on behalf of an organization:

If you choose to give us feedback, such as suggestions to improve our services, we may act on your feedback without obligation to you.
Some of our services give you the opportunity to make your content publicly available — for example, you might post a product review, or you might upload a blog post that you created.
When you make content publicly available in a service, it means that you are allowing anyone, including people off of NDmed.net, to access and use that content, and to associate it with you (i.e., your name and profile picture).
If you think someone is infringing your intellectual property rights, you can send us notice of the infringement and we’ll take appropriate action.
Some of our services include content that belongs to NDmed.net
NDmed.net content is the property of NDmed.net or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.
You may use NDmed.net’s content as allowed by these terms and any service-specific additional terms, but we retain any intellectual property rights that we have in our content. Don’t remove, obscure, or alter any of our branding, logos, or legal notices.
Finally, some of our services give you access to content that belongs to other people or organizations. You may not use this content without that person or organization’s permission, or as otherwise allowed by law. The views expressed in other people or organizations’ content are theirs, and don’t necessarily reflect NDmed.net's views.
Some of our services include downloadable software. We give you permission to use that software as part of the services.

Some of our services include software that’s offered under open source license terms that we make available to you. Sometimes there are provisions in the open source license that explicitly override parts of these terms, so please be sure to read those licenses.
You may not copy, modify, distribute, sell, or lease any part of our services or software.
THE SERVICES ARE PROVIDED BY NDmed.net ON AN "AS IS" AND "AS AVAILABLE" BASIS. NDmed.net MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICES, OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. WE DON’T MAKE ANY WARRANTIES ABOUT THE CONTENT OR FEATURES OF THE SERVICES, INCLUDING THEIR ACCURACY, RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS

NDmed.net is liable only for its breaches of these terms or applicable service-specific additional terms
NDmed.net is not liable for any indirect, special, incidental, or consequential damages (including lost profits) arising out of or relating to these terms or the services, even if NDmed.net has been advised of the possibility of those damages
NDmed.net isn’t liable for:
To the extent allowed by applicable law, you’ll indemnify NDmed.net and its directors, officers, employees, and contractors for any third-party legal proceedings (including actions by government authorities) arising out of or relating to your unlawful use of the services or violation of these terms or service-specific additional terms. This indemnity covers any liability or expense arising from claims, losses, damages, judgments, fines, litigation costs, and legal fees.
NDmed.net’s total liability arising out of or relating to these terms is limited to the greater of (1) $200 or (2) the fees paid to use the relevant services in the 12 months before the dispute
Before taking action as described below, we’ll provide you with advance notice when reasonably possible, describe the reason for our action, and give you an opportunity to fix the problem, unless doing so would:
If any of your content (1) breaches these terms, service-specific additional terms or policies, (2) violates applicable law, or (3) could harm our users, third parties, or NDmed.net, then we reserve the right to take down some or all of that content in accordance with applicable law. Examples include child pornography, content that facilitates human trafficking or harassment, terrorist content, and content that infringes someone else’s intellectual property rights.

Oregon law will govern all disputes arising out of or relating to these terms, service-specific additional terms, or any related services, regardless of conflict of laws rules. These disputes will be resolved exclusively in the federal or state courts of Hood River County, Oregon, USA, and you and NDmed.net consent to personal jurisdiction in those courts.
You are entitled to certain protections under the law that are unaffected by a contract like these terms of service. These terms do not in any way limit those rights.
The interaction between you and NDmed.net is defined by these terms. Even if other persons or organizations gain from the partnership under these terms, they do not confer any legal rights on them.
We've included examples from our services to help clarify these phrases so they're simple to understand. Unfortunately not all of the aforementioned services might be offered in your nation.
In the event of a discrepancy between these terms and the additional terms applicable to a particular service, the additional terms shall control.
If it turns out that a particular term is not valid or enforceable, this will not affect any other terms.
If you don’t follow these terms or the service-specific additional terms, and we don’t take action right away, that doesn’t mean we’re giving up any rights that we may have, such as taking action in the future.
We may update these terms and service-specific additional terms (1) to reflect changes in our services or how we do business — for example, when we add new services, features, technologies, pricing, or benefits (or remove old ones), (2) for legal, regulatory, or security reasons, or (3) to prevent abuse or harm.
If we materially change these terms or service-specific additional terms, we’ll provide you with reasonable advance notice and the opportunity to review the changes, except (1) when we launch a new service or feature, or (2) in urgent situations, such as preventing ongoing abuse or responding to legal requirements. If you don’t agree to the new terms, you should remove your content and stop using the services. You can also end your relationship with us at any time by closing your NDmed.net Account.
We reserve the right to take action at a later time if you violate these terms or the service-specific supplementary rules, even if we choose not to take action right away.
We reserve the right to modify these terms and any service-specific additional terms: (1) to reflect changes in our services or business practices, such as the addition of new services, features, technologies, pricing, or benefits; (2) for legal, regulatory, or security purposes; or (3) to prevent abuse or harm.
With the exception of (1) when we introduce a new service or feature, and (2) in emergency situations, such as preventing ongoing abuse or meeting legal obligations, we will give you adequate early notice and the chance to consider any substantial changes. Remove your material and cease using the services if you don't agree to the revised conditions. You may also terminate your account with NDmed.net at any time.
